The Motor Neurone Disease Association of WA (MNDAWA) does not provide liability insurance for the protection of individuals, groups, spectators, or others who may participate in the MNDAWA Soar to Support 2023.
I acknowledge that my participation in the MNDAWA Soar to Support 2023 is at MY OWN RISK.
If I suffer from any medical condition including but not limited to Motor Neurone Disease I acknowledge that I have received my own medical advice regarding participation in the MNDAWA Soar to Support 2023.
I also acknowledge that the risks associated with participating in the MNDAWA Soar to Support 2023 include (but are not limited to) that I may suffer harm as a result of:
- Injury prior, during or after the event;
- Acts of other persons (whether intentional or inadvertent) attending, officiating or participating in the MNDAWA Soar to Support 2023.
- Any medical condition that I or another participant may suffer from.
In consideration of my participation in the MNDAWA Soar to Support 2023 I hereby release and forever discharge MNDAWA, and its officers, board, employees and volunteers, jointly and severally from any and all actions, causes of actions, claims and demands for, upon or by reason of any damage, loss or injury including death, howsoever arising out of or in connection with my participation in the MNDAWA Soar to Support 2023, including without limitation liability for any negligent or torturous acts or omissions, breach of duty, breach of contract or breach of statutory duty on the part of MNDAWA, and its officers, board, employees and volunteers.
This release extends and applies to, and also covers and includes, all unknown, unforeseen, unanticipated and unsuspected injuries including death, damages, loss and liability and the consequences thereof, as well as those now disclosed and known to exist. The provisions of any state, federal, local or territorial law or statue providing in substance that releases shall not extend to claims, demands, injuries, or damages which are unknown or unsuspected to exist at this time, to the person executing such release, are hereby expressly waived.
I hereby agree on behalf of my heirs, executors, administrators, and assigns, to indemnify MNDAWA and its officers, board employees and volunteers, joint and severally from any and all actions, causes of actions, claims and demands for, upon or by reason of any damage, loss or injury including death, which hereafter may be sustained by participating in the MNDAWA Soar to Support 2023.
It is further understood and agreed that said participation in the MNDAWA Soar to Support 2023 is not to be construed as an admission of any liability and acceptance or assumption of responsibility by MNDAWA, its officers, board, employees and volunteers, jointly and severally, for all damages and expenses for which MNDAWA, its officers, board employees and volunteers, become liable as a result of any alleged act of any MNDAWA Soar to Support 2023.
